mediation and arbitrationMediation and arbitration are two processes used to resolve legal conflicts without going to trial. Newport & Associates is in the forefront of this area, advising and representing clients at arbitration and mediation. We have substantial experience and training in mediation and arbitration and routinely advise our clients on the legal consequences flowing from particular terms and conditions included in contracts specifying the use of mediation or arbitration. Arbitration involves presentation of a case by a plaintiff and a defendant in much the same manner as a case is presented in a courtroom. The arbitrator acts as the judge and jury rendering an arbitration decision which can later be confirmed with a Court at Law. The decision is final and review of an arbitrator's decision by a Court at Law is usually only permitted for a very few reasons. Mediation is a process used to settle disputes between parties in a lawsuit. A neutral mediator is selected by the parties who then attempts to broker a compromise in an attempt to settle the legal controversy. Almost all cases attend at least one mediation before trial of a case. |
